Ted Leo's main point in this song is that it is criminal to keep quiet about something you feel strongly about. More specifically, I think he is talking about speaking out against political matters that we might be against.

its about an optimistic criminal in captivity, but he is looking on the bright side, even in the worst possible situations "no more bad weather underground" and telling everyone to live life.
I think "weather underground" is a reference to the youth organization that existed in the 70s. The were primarily against the war in vietnam but also considered themselves part of the leftist movement. More info: http://en.wikipedia.org/wiki/Weather_underground
To me this is about all of the Baby Boomer hippies who were virulently against the war in Vietnam but became more conservative or "moderate" as they grew older, had kids, and settled down. The song is a call to arms, telling them to remember how they used to fight against the establishment that they are now a part of. It could also be directed at Congressional Democrats who didn't stand up to Bush and the Republicans on the march to war in Iraq.
