This is such an amazing song but when I hear it, I picture it taking place in the 1800's or so. I just see it as there is some sort of corrupt government, and there is a widespread revolution. The revolutionaries are wearing some type of recognizable clothing or symbol such as the masks in V for Vendetta or having their hoods up.

The person that the song revolves around happens to be some kind of revolutionary leader. After a speech or rally, the police/authorities follow the man home. When they break into his house to arrest him, the man says "The man you're looking for does not exist
He's just a figment of the higher man's tongue" What I interpret is that he is saying that there is no real leader, it is the spirit of the revolution that leads the people. "I ain't opposed to seeking justice
But you're going about it all wrong" makes me think that he's trying to say that he hasn't committed any crimes, he is merely trying to help the government by getting rid of the tyrants, therefore his arrest is unjust.

Finally, when he is at the execution and the boy asks why he is smiling, he responds "I said I tell you boy when I get back" I interpret this as him saying that even when he is dead, the spirit of the revolution will live on. Once he is gone, there will be others to take his place, therefore its as if he never died.

Now that I look at it though, the criminal crosser and a few other lyrics do sort of hint at the border.
